ESA RENTAL CAR POLICY

  

1. Renter shall supply gasoline for vehicle during rental period and pay any traffic fee incurred during rental period.

2. Rental shall lock vehicle securely and retain vehicle key when vehicle is not in use. 

3. Only renters may drive the vehicle during rental period and shall not assign or transfer renters right under this agreement.

4. Renter shall not use vehicle for racing or for carriage of goods or sample in connections with trade or business or while intoxicated, or violation of the law. 

5. Proprietor shall not be responsible for any loss or destruction or renter’s property maintained in the vehicle or for injury of death of renter or passengers occurring from use, any way connected with vehicle during rental period. 

6. In case of accident renter shall report to Yap State Constabulary immediately. In case of accident or mechanical difficulty, renter shall report immediately to the proprietor. 

7. Renter and not the proprietor, shall be responsible for any liability incurred by the renter during rental period, and shall hold proprietor harmless from any suit or the man related thereto issuing from any party. 

8. Renter shall pay proprietor for any damage to vehicle or loss of vehicle parts or accessories occurring during the rental period. Whether or not due to renters fault and such payment shall include proprietor loss to use during any period of repair. Proprietor agrees to return to renter any portion of such payment for which proprietor is reimbursed under any insurance agreement. 

9. Upon of return of vehicle, renter shall pay proprietor a rental sum according to the rates set forth. Above and additional thereto and amount representing fair value of proprietors loss due to damage or loss of vehicle or accessories during rental period. Renter shall reimburse proprietors for any expense incurred on collecting an amount due in this agreement from renter, including court cost and reasonable attorney fees. 

10. Violation of any term of agreements by renter shall give proprietor the right to demand and have immediate return of the vehicle upon demand and payment of the total amount due.
